Die Mission von mindDIVING ist es, Die Mission von mindDIVING ist es, Menschen mit relevanten Informationen zu versorgen, um ein besseres Verst\u00e4ndnis f\u00fcr das eigene Empfinden von Gl\u00fcck und Wohlbefinden zu entwickeln um so gezielt Handlungen auszuf\u00fchren, die zu Gl\u00fcck, Wohlbefinden und Gesundheit f\u00fchren. Daher bietet MindDIVING verschiedenen Stellen an, einen sog. Informationsvertrag zu schlie\u00dfen. Dabei verpflichtet sich MindDIVING gegen\u00fcber den Informationsbestellern, sie regelm\u00e4\u00dfig mit Weiterbildungs- und Schulungsmaterial, aber auch mit allgemeinen Informationen zu versorgen. Hierbei sind drei wesentliche Vertragsbestandteilebesonders wichtig: Erstens wird der Gegenstand des jeweiligen Informationsvertrages einerseits bei der konkreten Bestellung und erg\u00e4nzend durch diese Allgemeinen Informationsbedingungen (AIB) bestimmt. Zweitens kann der Informationsbesteller den Vertrag jederzeit, ohne Angabe von Gr\u00fcnden und formlos beenden. Drittens ist dieser Informationsservice unentgeltlich.<\/p>\n
(1) Gegenstand des Vertrages ist es, dass MindDIVING den Informationsbesteller mit Informationen \u00fcber alle denkbaren Kontaktkan\u00e4le (Briefpost, SMS, E-Mail, soziale Netzwerke und vergleichbare Kontaktkan\u00e4le) versorgt. Grunds\u00e4tzlich sind die Themen dieser Informationen durch den konkreten Informationsvertrag (Produkt- und\/oder Leistungsbeschreibung) festgelegt. In jedem Fall k\u00f6nnendies aber Informationen aus den folgenden Themenbereichen sein: neue mindDIVING Produktupdates, Anwendung von mindDIVING und verwandten Produkten Dritter, Methoden und Wissen \u00fcber Geistesschulung wie Meditation, Neurowissenschaften und vergleichbare Themen, Seminare und Webinare von mindDIVING, Seminare und Webinare Dritter, Empfehlungen geeigneter Produkte Dritter.<\/p>\n
(2) With regard to paragraph 1, MindDIVING is also obligated, among other things, to deliver the information covered by this agreement via social networks and similar communication channels. To this end, MindDIVING is obligated, to the extent technically possible, to upload the email address to a Custom Audience on Facebook or to a \"similar audience\" on Google and, if possible, to deliver information there as well. This is subject to the provision in paragraph 3.<\/p>\n
(3) MindDIVING is furthermore obligated, within the scope of its technical capabilities, to exclude information subscribers who are already registered for a webinar from advertisements for potential new webinar or training participants on Facebook or Google. To this end, MindDIVING must upload the email address to a Custom Audience on Facebook or a \"similar audience\" on Google. Information subscribers will then be excluded from advertisements for potential new training participants.<\/p>\n
(4) There is no entitlement to the coverage of all these topics.<\/p>\n
(5) Ferner schuldet MindDIVING auch keine Beratung und auch nicht die Pr\u00fcfung dieser Informationen aufinhaltliche Richtigkeit, sondern nur die Verschaffung der Informationen.<\/p>\n
(1) The information contract is concluded when the information requester requests a service from Digistore24 GmbH and\/or MindDIVING, either digitally, in writing or in another unambiguous form (including implied), in whose product or service description references the conclusion of an information contract.<\/p>\n
(2) These AIBs shall also become part of the contract.<\/p>\n
The person requesting the information does not have to pay any money for obtaining the information.<\/p>\n
(1) Both parties may terminate the contract at any time without giving reasons and without observing any notice period.<\/p>\n
(2) If the customer is also a customer of Digistore24 GmbH and receives access to MindDIVING through this contractual relationship, the existence of this information agreement is not dependent on the existence of the agreement with Digistore24 GmbH.<\/p>\n
(1) MindDIVING shall only be liable without limitation for intent and gross negligence.<\/p>\n
(2) MindDIVING shall only be liable for simple negligence \u2013 except in the case of injury to life, body or health \u2013 if essential contractual obligations (cardinal obligations) are breached.<\/p>\n
(3) Liability for indirect and unforeseeable damages, loss of production and use, lost profits, lost savings and pecuniary losses due to claims by third parties is excluded in the case of simple negligence \u2013 except in the case of injury to life, body or health.<\/p>\n
(4) Eine weitergehende Haftung als in diesem Vertrag ist \u2013 ohne R\u00fccksicht auf die Rechtsnatur des geltend gemachten Anspruchs \u2013 ausgeschlossen. Vorstehende Haftungsbeschr\u00e4nkungen bzw. – ausschl\u00fcsse gelten jedoch nicht f\u00fcr eine gesetzlich zwingend vorgeschriebene verschuldensunabh\u00e4ngige Haftung (z. B. gem\u00e4\u00df Produkthaftungsgesetz) oder die Haftung aus einer verschuldensunabh\u00e4ngigen Garantie.<\/p>\n
(5) To the extent that liability is excluded or limited under paragraphs 2 and 3, this also applies to the personal liability of MindDIVING's employees, workers, representatives, officers and agents.<\/p>\n
MindDIVING ist berechtigt, diese AIB einseitig zu \u00e4ndern, soweit dies zur Beseitigung nachtr\u00e4glich entstehender \u00c4quivalenzst\u00f6rungen oder zur Anpassung an ver\u00e4nderte gesetzliche oder technische Rahmenbedingungen oder zur Erweiterung des Informationsangebots oder der Informationskan\u00e4le notwendig ist. \u00dcber eine \u00c4nderung wird der Informationsbesteller unter Mitteilung des Inhalts derge\u00e4nderten Regelungen an die zuletzt bekannte E-Mail-Adresse informiert. Die \u00c4nderung wird Vertragsbestandteil, wenn der Informationsbesteller nicht binnen sechs Wochen nach Zugang der \u00c4nderungsmitteilung der Einbeziehung in das Vertragsverh\u00e4ltnis MindDIVING gegen\u00fcber in Schrif toder Textform widerspricht.<\/p>","protected":false},"excerpt":{"rendered":"
